Article L3514-3 of the French Public Health Code

I.-The labelling of unit packets, any outer packaging and the herbal smoking product other than tobacco itself may not include any element or device that :

1° Contributes to the promotion of the product or encourages its consumption by giving an erroneous impression as to the characteristics, health effects, risks or emissions of the product; labels shall not include any information on the nicotine, tar or carbon monoxide content of the product;

2° Suggests that a product is less harmful than others or is intended to reduce the effect of certain harmful components of smoke or has vitalising, energising, healing, rejuvenating, natural or organic properties or has beneficial effects on health or lifestyle;

3° Indicates that the product is free from additives or flavourings;

4° Resembles a food or cosmetic product.

II – The elements and devices prohibited under I include messages, symbols, names, product or service brands, figurative or other signs.

I.-L’étiquetage des unités de conditionnement, tout emballage extérieur ainsi que le produit à fumer à base de plantes autres que le tabac proprement dit ne peuvent comprendre aucun élément ou dispositif qui :

1° Contribue à la promotion du produit ou incite à sa consommation en donnant une impression erronée quant aux caractéristiques, effets sur la santé, risques ou émissions du produit ; les étiquettes ne comprennent aucune information sur la teneur en nicotine, en goudron ou en monoxyde de carbone du produit ;

2° Suggère qu’un produit est moins nocif que d’autres ou vise à réduire l’effet de certains composants nocifs de la fumée ou présente des propriétés vitalisantes, énergisantes, curatives, rajeunissantes, naturelles, biologiques ou a des effets bénéfiques sur la santé ou le mode de vie ;

3° Indique que le produit est exempt d’additifs ou d’arômes ;

4° Ressemble à un produit alimentaire ou cosmétique.

II.-Les éléments et dispositifs qui sont interdits en vertu du I comprennent notamment les messages, symboles, noms, marques de produits ou de services, signes figuratifs ou autres.
