Article L352-2 of the French Insurance Code

Where the application of the standard formula proves inappropriate for calculating the Solvency Capital Requirement of an insurance or reinsurance undertaking whose risk profile deviates significantly from the assumptions underlying the calculation in accordance with that formula, the Autorité de contrôle prudentiel et de résolution may, in a reasoned decision, require the undertaking concerned to use an internal model to calculate its Solvency Capital Requirement or the relevant risk modules thereof.

Lorsque l’application de la formule standard s’avère inappropriée pour calculer le capital de solvabilité requis d’une entreprise d’assurance ou de réassurance dont le profil de risque s’écarte significativement des hypothèses qui sous-tendent le calcul suivant cette formule, l’Autorité de contrôle prudentiel et de résolution peut, par décision motivée, exiger de l’entreprise concernée qu’elle utilise un modèle interne pour calculer son capital de solvabilité requis ou les modules de risque pertinents de celui-ci.
