Article L356-13 of the French Insurance Code

Notwithstanding the provisions of Article L. 356-11, where the prudential regime of a third country has been recognised as temporarily equivalent by a delegated act of the European Commission, the Autorité de contrôle prudentiel et de résolution nevertheless exercises the function of group supervisor in the event that a subsidiary of an insurance or reinsurance undertaking whose head office is in France has a balance sheet total greater than the balance sheet total of its parent undertaking whose head office is outside the European Union.

Par dérogation aux dispositions de l’article L. 356-11, lorsque le régime prudentiel d’un pays tiers a été reconnu temporairement équivalent par un acte délégué de la Commission européenne, l’Autorité de contrôle prudentiel et de résolution exerce néanmoins la fonction de contrôleur de groupe dans le cas où une filiale d’une entreprise d’assurance ou de réassurance ayant son siège social en France a un bilan total supérieur au bilan total de son entreprise mère dont le siège social se situe en dehors de l’Union européenne.
