At the justified request of the supervisory authority of the home Member State of the undertakings, the Autorité de contrôle prudentiel et de résolution shall restrict or prohibit the free disposal of all or part of those assets of insurance or reinsurance undertakings whose head office is situated within the territory of a Member State of the European Union other than France which are located within the territory of the French Republic and which have been designated by the supervisory authority of the home Member State as being subject to such measures.
When it is informed that an insurance or reinsurance undertaking whose head office is located in the territory of a Member State of the European Union other than France operating in France under the freedom to provide services or the freedom of establishment has had its authorisation withdrawn or is being wound up, the Autorité de contrôle shall assist the supervisory authority of the home Member State and, at the latter’s request, shall take the necessary measures to protect the interests of policyholders, under the conditions defined in Article L. 323-1-1.
