The transfer of all or part of a portfolio of insurance contracts concluded in the territory of the French Republic under the right of establishment or the freedom to provide services from an insurance undertaking in the European Union to an assignee established in a Member State of the European Union or to an assignee authorised in accordance with the provisions of articles L. 321-7 and L. 329-1 may be invoked against policyholders, policyholders, beneficiaries of contracts and creditors provided that the provisions of the first sentence of the second paragraph of article L. 324-1 have been complied with and that the Autorité de contrôle prudentiel has not objected to the planned transfer.
The transfer is enforceable from the day on which the decision of the competent authorities of the States concerned authorising it has been made public by a notice published in the Official Journal. However, policyholders may cancel the contract within one month of the date of publication.
