I.-When a request for admission to psychiatric care has been submitted under the conditions provided for in 1° of II of article L. 3212-1 or when an imminent danger to the patient’s health has been established under the conditions provided for in 2° of the same II, the State representative shall, with a view to admitting the patient into psychiatric care, issue an order for the patient’s medical transfer to an establishment located in New Caledonia or French Polynesia and authorised to treat people suffering from mental disorders in accordance with locally applicable regulations.
II – Similarly, the High Administrator shall issue a health transfer order for a person whose mental disorder requires care and compromises his or her safety or that of other persons or seriously undermines public order.
III – The health transfer order is based on the detailed medical certificate(s) stating that the person concerned has a mental disorder requiring care with constant or regular supervision in an establishment authorised to treat people with mental disorders. In addition, where appropriate, reasons are given in the light of the report drawn up by the police authorities establishing the risk of harm to personal safety and public order.
