Article L4021-5 of the French Public Health Code

Continuing professional development is carried out in compliance with the rules of organisation and management specific to the different sectors of activity of health professionals, in particular by employers or by the bodies mentioned in articles L. 6331-1 and L. 6332-9 of the Labour Code and in II of article 16 of order no. 2005-406 of 2 May 2005 simplifying the legal regime of health establishments. The monitoring of compliance by healthcare professionals with their continuing professional development obligation is carried out by professional bodies, employers and the competent authorities, under conditions set by decree in the Conseil d’Etat.

Le développement professionnel continu se réalise dans le respect des règles d’organisation et de prise en charge propres aux différents secteurs d’activité des professionnels de santé, notamment par les employeurs ou par les organismes mentionnés aux articles L. 6331-1 et L. 6332-9 du code du travail ainsi qu’au II de l’article 16 de l’ordonnance n° 2005-406 du 2 mai 2005 simplifiant le régime juridique des établissements de santé. Le contrôle du respect par les professionnels de santé de leur obligation de développement professionnel continu est réalisé par les instances ordinales, les employeurs et les autorités compétentes, dans des conditions fixées par décret en Conseil d’Etat.
