Article L410-6 of the French Commercial code

I. – On an experimental basis and for a period of five years from 1 July 2017, in the Department of Mayotte and French Guiana, following a public opinion from the territorially competent observatory of prices, margins and incomes, the State representative shall negotiate each year with the large and medium-sized retailers present in the territory a maximum professional tariff for their wholesale activity with regard to small retail outlets registered with the trade and companies register.

II. – If no agreement is reached within one month of the start of negotiations, the State representative will decide, on the basis of the negotiations referred to in I, on the maximum professional tariff and its framework. The procedures for calculating a maximum tariff consist of a percentage increase in relation to the purchase price of large and medium-sized supermarkets or a percentage reduction in relation to the prices charged to consumers.

Article L410-6

I. – A titre expérimental et pour une durée de cinq ans à compter du 1er juillet 2017, dans le Département de Mayotte et en Guyane, après avis public de l’observatoire des prix, des marges et des revenus territorialement compétent, le représentant de l’Etat négocie chaque année avec les grandes et moyennes surfaces présentes sur le territoire un tarif professionnel maximal pour leur activité de gros à l’égard des petites surfaces de commerce de détail enregistrées au registre du commerce et des sociétés.

II. – En l’absence d’accord dans un délai d’un mois à compter de l’ouverture des négociations, le représentant de l’Etat arrête, sur la base des négociations mentionnées au I, le tarif professionnel maximal ainsi que ses modalités d’encadrement. Les modalités de calcul d’un tarif maximal consistent en un pourcentage de majoration par rapport au prix d’achat des grandes et moyennes surfaces ou en un pourcentage de minoration par rapport aux prix facturés aux consommateurs.
