Article L4154-1 of the French Labour Code

It is forbidden to use an employee holding a fixed-term employment contract or a temporary employee to carry out particularly dangerous work included on a list drawn up by regulation. This list includes, in particular, some of the work that is subject to enhanced medical supervision within the meaning of the regulations relating to occupational medicine.

The administrative authority may exceptionally authorise a derogation from this prohibition under conditions determined by regulation.

Il est interdit de recourir à un salarié titulaire d’un contrat de travail à durée déterminée ou à un salarié temporaire pour l’exécution de travaux particulièrement dangereux figurant sur une liste établie par voie réglementaire. Cette liste comporte notamment certains des travaux qui font l’objet d’une surveillance médicale renforcée au sens de la réglementation relative à la médecine du travail.

L’autorité administrative peut exceptionnellement autoriser une dérogation à cette interdiction dans des conditions déterminées par voie réglementaire.
