The following are prohibited in communities falling under Article 73 of the Constitution and in the overseas collectivities of Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon and Wallis-et-Futuna, agreements or concerted practices the object or effect of which is to grant exclusive import rights to an undertaking or group of undertakings shall be prohibited.
It is also prohibited in the collectivities mentioned in the first paragraph of this article for an undertaking engaged in wholesale import or retail trade, or for a group of undertakings of which at least one of the entities is engaged in one of these activities, to apply discriminatory conditions relating to products or services for which a situation of de facto exclusive import exists against an undertaking in which it does not hold any share of the capital.
