Article L421-10-3 of the French Insurance Code

Where an insurance or reinsurance undertaking operating in the territory of the French Republic fails to comply with the rules imposed on it by virtue of this section, the guarantee fund shall inform the Autorité de contrôle prudentiel et de résolution. The latter shall carry out its supervision and, if necessary, implement sanction procedures, in accordance with the conditions set out in Article L. 363-4 and Chapter II of Title I of Book VI of the Monetary and Financial Code.

Lorsqu’une entreprise d’assurance ou de réassurance opérant sur le territoire de la République française ne respecte pas les règles qui s’imposent à elle en vertu de la présente section, le fonds de garantie en informe l’Autorité de contrôle prudentiel et de résolution. Celle-ci exerce son contrôle et met en œuvre, le cas échéant, les procédures de sanctions, dans les conditions prévues par l’article L. 363-4 et par le chapitre II du titre Ier du livre VI du code monétaire et financier.
