Article L421-14 of the French Insurance Code

A decree of the Conseil d’Etat shall lay down the conditions for the application of this section, in particular the procedures for establishing that the conditions for the intervention of the guarantee fund have been met, the procedures for the payment of compensation to victims via the national insurance bureaux, and the procedures for the exercise by the guarantee fund of the right of subrogation provided for in article L. 421-13.

A Conseil d’Etat decree sets out the conditions for adapting this section in the overseas departments and in Saint-Barthélemy and Saint-Martin.

Article L421-14

Un décret en Conseil d’Etat fixe les conditions d’application de la présente section, notamment les modalités selon lesquelles est constatée la réunion des conditions entraînant l’intervention du fonds de garantie, les modalités de versement de l’indemnité aux victimes par l’intermédiaire des bureaux nationaux d’assurance, ainsi que les modalités de l’exercice par le fonds de garantie du droit de subrogation prévu à l’article L. 421-13.

Un décret en Conseil d’Etat fixe les conditions d’adaptation de la présente section dans les départements d’outre-mer ainsi qu’à Saint-Barthélemy et à Saint-Martin.
