Article L421-3 of the French Insurance Code

The guarantee fund is subrogated to the rights of the compensation creditor against the person responsible for the accident or his insurer. It is also entitled to interest calculated at the legal rate in civil matters and to recovery costs.

When the guarantee fund settles with the victim, this settlement is enforceable against the person responsible for the damage, except for the latter’s right to contest before the judge the amount of the sums claimed from him as a result of this settlement. This dispute may not have the effect of calling into question the amount of compensation awarded to the victim or to his heirs.

Le fonds de garantie est subrogé dans les droits que possède le créancier de l’indemnité contre la personne responsable de l’accident ou son assureur. Il a droit, en outre, à des intérêts calculés au taux légal en matière civile et à des frais de recouvrement.

Lorsque le fonds de garantie transige avec la victime, cette transaction est opposable à l’auteur des dommages, sauf le droit pour celui-ci de contester devant le juge le montant des sommes qui lui sont réclamées du fait de cette transaction. Cette contestation ne peut avoir pour effet de remettre en cause le montant des indemnités allouées à la victime ou à ses ayants droit.
