Article L421-6 of the French Insurance Code

A decree of the Conseil d’Etat shall lay down the conditions for the application of articles L. 421-1 to L. 421-5 and in particular the legal bases and procedures for determining the compensation which may be payable by the guarantee fund, the persons excluded from the benefits of the fund, the respective or reciprocal obligations and rights of the guarantee fund, the insurer, the person responsible for the accident, the victim or their successors, the deadlines set for exercising these rights or enforcing these obligations, the conditions under which the guarantee fund operates and can intervene in legal proceedings, the conditions under which it can be called into question in exceptional circumstances, and the terms and conditions of the control exercised over the entire management of the fund by the Minister of the Economy and Finance.

Un décret en Conseil d’Etat fixe les conditions d’application des articles L. 421-1 à L. 421-5 et notamment les bases et modalités juridiques de détermination des indemnités pouvant être dues par le fonds de garantie, les personnes exclues du bénéfice du fonds, les obligations et droits respectifs ou réciproques du fonds de garantie, de l’assureur, du responsable de l’accident, de la victime ou de ses ayants droit, les délais assignés pour l’exercice de ces droits ou la mise en jeu de ces obligations, les conditions de fonctionnement, d’intervention en justice du fonds de garantie, les conditions dans lesquelles il peut être exceptionnellement mis en cause, les modalités du contrôle exercé sur l’ensemble de la gestion du fonds par le ministre de l’économie et des finances.
