Article L421-7 of the French Insurance Code

When the perpetrator of an accident is unable to prove that he has complied with the obligation to insure instituted by article L. 211-1, the victim and the guarantee fund are entitled to avail themselves of the precautionary measures provided for in articles 48 to 57 of the Code of Civil Procedure (1).

However, these provisions do not apply when the civil liability insurance concerns vehicles normally based in the territory of a State referred to in article L. 211-4 with the exception of France and Monaco.

Article L421-7

Lorsque l’auteur d’un accident n’est pas en mesure de justifier qu’il a été satisfait à l’obligation d’assurance instituée par l’article L. 211-1, la victime et le fonds de garantie sont fondés à se prévaloir des mesures conservatoires prévues aux articles 48 à 57 du code de procédure civile (1).

Toutefois, ces dispositions ne sont pas applicables lorsque l’assurance de la responsabilité civile concerne des véhicules ayant leur stationnement habituel sur le territoire d’un Etat visé à l’article L. 211-4 à l’exception de la France et de Monaco.
