Notwithstanding article L. 4221-1, persons who hold a diploma, certificate or other qualification mentioned in articles L. 4221-2 to L. 4221-5, but who do not hold one of the nationalities mentioned in article L. 4221-1, as well as French or foreign persons holding a diploma, title or certificate of scientific value attested by the minister responsible for higher education and who have worked for at least three years before 1st January 1999, in public health establishments or in private health establishments participating in the public hospital service, in functions determined by decree, placing them under the responsibility of a pharmacist, may be individually authorised by order of the minister responsible for health to work in these establishments and blood transfusion establishments as contract staff. Periods spent preparing specialised diplomas are not taken into account when calculating the length of service.
The persons concerned must have passed national aptitude tests organised before 31 December 2001 and defined by regulatory provisions adopted in application of article L. 6152-1. By way of derogation from the foregoing provisions, refugees, stateless persons and beneficiaries of territorial asylum, as well as French nationals holding a foreign diploma who have returned to France at the request of the French authorities, may apply for these tests without fulfilling the condition of working in health establishments mentioned in the previous paragraph.
With a view in particular to guaranteeing health safety, the conditions under which pharmacists are recruited and carry out their activities are determined by decree in the Conseil d’Etat.
The persons concerned are entered on the relevant roll of the national order of pharmacists. They are required to comply with the rules mentioned in article L. 4231-1 and those laid down in application of article L. 4235-1.
