Where appropriate, the Disciplinary Board will impose one of the following penalties:
1° A warning ;
2° A reprimand with an entry in the file;
3° A temporary or permanent ban on serving any or all supplies made, in any capacity whatsoever, to public establishments or establishments recognised as being of public utility, to municipalities, departments or to the State;
4° Prohibition from practising pharmacy for a maximum of five years, with or without suspended sentence;
5° A permanent ban on practising pharmacy.
The last two penalties include a permanent ban on being a member of an Association Council.
If, for acts committed within five years of notification of a suspended sanction, once that sanction has become final, the court imposes the sanction provided for in 4°, it may decide that the suspended part of the sanction becomes enforceable without prejudice to the application of the new sanction.
When the disciplinary chambers of the regional councils of section A and the central councils of the other sections of the Association impose a ban on practising the profession, they set the starting date of this ban. Decisions handed down by these disciplinary chambers, which have not been appealed within the legal time limits, are enforceable.
