Article L424-3 of the French Insurance Code

The compensation body intervenes within two months of the date on which the injured party submits a claim for compensation. It will cease to intervene if, within this two-month period, the insurance undertaking or its claims representative has given a reasoned response to the claim.

The compensation body’s offer is subsidiary. It pays the compensation that cannot be paid under any other heading, awarded to the victims or their dependants, when the accident gives rise to a right to compensation. Payments made to victims or their dependants which cannot give rise to a recourse action against the party responsible for the damage are not considered as compensation in any other capacity.

L’organisme d’indemnisation intervient dans un délai de deux mois à compter de la date à laquelle la personne lésée lui présente une demande d’indemnisation. Il cesse son intervention si, dans ce délai de deux mois, l’entreprise d’assurance ou son représentant chargé du règlement des sinistres a donné une réponse motivée à la demande.

L’offre de l’organisme d’indemnisation a un caractère subsidiaire. Il paye les indemnités qui ne peuvent être prises en charge à aucun autre titre, allouées aux victimes ou à leurs ayants droit, lorsque l’accident ouvre droit à réparation. Les versements effectués au profit des victimes ou de leurs ayants droit et qui ne peuvent pas donner lieu à une action récursoire contre le responsable des dommages ne sont pas considérés comme une indemnisation à un autre titre.
