Article L424-5 of the French Insurance Code

When the compensation body has reimbursed the sums incurred by its counterparts in the other States party to the European Economic Area, it is then subrogated to the rights of the injured party and the body which compensated him/her against the person who caused the accident or the insurance company which provides its guarantee or the guarantee fund provided for in article L. 421-1.

Article L424-5

Lorsque l’organisme d’indemnisation a remboursé les sommes exposées par ses homologues des autres Etats parties à l’Espace économique européen, il est alors subrogé dans les droits de la personne lésée et de l’organisme qui l’a indemnisée à l’encontre de la personne ayant causé l’accident ou de l’entreprise d’assurance qui lui accorde sa garantie ou du fonds de garantie prévu à l’article L. 421-1.
