Article L424-7 of the French Insurance Code

Where it has intervened under the conditions provided for in c) of Article L. 424-2, the compensation body shall have a claim :

a) The guarantee fund of the State where the accident took place in the case of a vehicle from a third country ;

b) The guarantee fund of the State where the vehicle is normally based if the insurance undertaking cannot be identified;

c) The guarantee fund of the State where the accident took place in the case of an unidentified vehicle.

The claim of the compensation body shall include, in addition to the compensation and the related expenses, the costs of its administration in accordance with the agreement concluded between the compensation bodies set up or approved by the Member States.

Lorsqu’il est intervenu dans les conditions prévues par le c de l’article L. 424-2, l’organisme d’indemnisation possède une créance :

a) Sur le fonds de garantie de l’Etat où l’accident a eu lieu dans le cas d’un véhicule d’un pays tiers ;

b) Sur le fonds de garantie de l’Etat où le véhicule a son stationnement habituel si l’entreprise d’assurance ne peut être identifiée ;

c) Sur le fonds de garantie de l’Etat où l’accident a eu lieu dans le cas d’un véhicule non identifié.

La créance de l’organisme d’indemnisation comprend, outre l’indemnité et les frais y afférents, les frais de sa gestion selon l’accord conclu entre les organismes d’indemnisation créés ou agréés par les Etats membres.
