Article L431-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When a foreign national has submitted an application for asylum which falls within France’s jurisdiction, the administrative authority, after informing the foreign national of the grounds on which a residence permit may be issued and the consequences of not submitting an application on other grounds at this stage, asks the foreign national to state whether he/she believes he/she is entitled to claim admission to residence on another basis and, if so, to submit his/her application within a period set by decree. They are informed that, subject to new circumstances, in particular for health reasons, and without prejudice to article L. 611-3, they may not, on expiry of this period, apply for admission to residence.
The conditions for application of this article are specified by decree in the Conseil d’Etat.

Article L431-2

Lorsqu’un étranger a présenté une demande d’asile qui relève de la compétence de la France, l’autorité administrative, après l’avoir informé des motifs pour lesquels une autorisation de séjour peut être délivrée et des conséquences de l’absence de demande sur d’autres fondements à ce stade, l’invite à indiquer s’il estime pouvoir prétendre à une admission au séjour à un autre titre et, dans l’affirmative, à déposer sa demande dans un délai fixé par décret. Il est informé que, sous réserve de circonstances nouvelles, notamment pour des raisons de santé, et sans préjudice de l’article L. 611-3, il ne pourra, à l’expiration de ce délai, solliciter son admission au séjour.
Les conditions d’application du présent article sont précisées par décret en Conseil d’Etat.
