Holding a provisional document issued in connection with an application for a residence permit, an asylum application certificate or a provisional residence permit authorises the foreign national’s presence in France without prejudging the final decision that will be taken with regard to their right to residence. Subject to the exceptions provided for by law or regulations, these documents do not authorise their holders to engage in professional activity.
By way of derogation from article L. 431-3, the temporary residence permit provided for in articles L. 425-4 or L. 425-10 authorises its holder to engage in professional activity.
The issue of a provisional document issued in connection with an application for a residence permit, an asylum application certificate or a provisional residence permit does not have the effect of regularising the conditions of entry into France, except in the case of a foreign national who has been recognised as a refugee or granted the benefit of subsidiary protection pursuant to Book V.
The issue of a temporary or multi-annual residence permit or a resident permit may, by a reasoned decision, be refused to any foreigner whose presence in France constitutes a threat to public order.
The renewal of a temporary or multi-annual residence permit may, by a reasoned decision, be refused to a foreign national who ceases to fulfil one of the conditions required for the issue of this permit of which he or she is the holder, obstructs checks or fails to comply with summonses.
A resident card may not be issued to the spouses of a foreign national living in France in a state of polygamy. The same applies to any foreigner convicted of committing the offence of violence leading to permanent mutilation or disability, as defined in article 222-9 of the Criminal Code, or having been an accomplice thereto.
A temporary or multi-annual residence permit may, by a reasoned decision, be withdrawn from any foreign national whose presence in France constitutes a threat to public order.
