Without prejudice to the provisions of article L. 412-1, prior to the issue of a first residence permit, a foreign national who has entered France without the documents and visas required by the international conventions and regulations in force or who, aged over eighteen, has not, after a period of three months or a longer period set by decree by the Conseil d’Etat has elapsed since entering France, has not been issued with a residence permit, pays a regularisation visa fee of 200 euros, of which 50 euros, non-refundable, is collected at the time of application for the permit.
This provision does not apply to refugees, stateless persons and beneficiaries of subsidiary protection and to foreign nationals mentioned in articles L. 423-22, L. 426-1, L. 426-2 and L. 426-3.
The visa mentioned in the first paragraph takes the place of the long-stay visa provided for in the last paragraph of article L. 312-2 if the conditions for applying for it are met.
