Article L435-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The foreign national taken in by the organisations mentioned in the first paragraph of article L. 265-1 of the code de l’action sociale et des familles and who can provide proof of three years’ uninterrupted employment with the latter, the real and serious nature of this employment and their prospects of integration, may be issued with a temporary residence permit bearing the wording “employee”, “temporary worker” or “private and family life”, without the condition set out in article L. 412-1 being applicable.

The detailed rules for the application of this article are defined by decree in the Conseil d’Etat.

L’étranger accueilli par les organismes mentionnés au premier alinéa de l’article L. 265-1 du code de l’action sociale et des familles et justifiant de trois années d’activité ininterrompue au sein de ce dernier, du caractère réel et sérieux de cette activité et de ses perspectives d’intégration, peut se voir délivrer une carte de séjour temporaire portant la mention ” salarié “, ” travailleur temporaire ” ou ” vie privée et familiale “, sans que soit opposable la condition prévue à l’article L. 412-1.


Les modalités d’application du présent article sont définies par décret en Conseil d’Etat.
