A nurse who is a national of a Member State of the European Union or of another State party to the Agreement on the European Economic Area, who is established and legally practises the activities of a nurse responsible for general care in a Member State or State party, may perform professional acts in France, on a temporary and occasional basis, without having to go through the formalities provided for in article L. 4311-15.
The performance of these acts is subject to a prior declaration, which must be accompanied by supporting documents, the list of which is set by order of the Minister for Health. The service provider must include a declaration of the language skills required to provide the service.
Checks on language proficiency must be proportionate to the activity to be performed and carried out once the professional qualification has been recognised.
The service provider must have knowledge of the systems of weights and measures used in France.
The service provider is subject to the conditions of practice of the profession, the professional rules applicable in France and the competent disciplinary jurisdiction.
Where the evidence of formal qualifications does not benefit from recognition pursuant to Article L. 4311-3, the professional qualifications of the service provider are verified before the first service is provided. In the event of a substantial difference between the qualifications of the service provider and the training required in France, which is likely to be detrimental to public health, the competent authority shall subject the professional to an aptitude test.
Nurses may use their evidence of formal qualifications in the language of the State which issued them. He or she must indicate the place and establishment where he or she obtained it.
In the event that the evidence of formal qualifications from the Member State or part of the Member State of origin is likely to be confused with evidence of formal qualifications requiring additional training in France, the Conseil national de l’ordre may decide that the person concerned will refer to the evidence of formal qualifications from the Member State or part of the Member State of origin in an appropriate form indicated by the Conseil national de l’ordre.
The service is provided under the French professional title of nurse. However, where the evidence of formal qualifications does not benefit from recognition pursuant to Article L. 4311-3 and where the qualifications have not been verified, the service is provided under the professional title of the Member State of establishment, so as to avoid any confusion with the French professional title.
The declaration shall specify, where applicable, that it concerns the practice of the speciality of nurse anaesthetist, operating theatre nurse or nursery nurse.
