Article L436-4 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Without prejudice to the provisions of article L. 412-1, prior to the issue of a first residence permit, a foreign national who has entered France without the documents and visas required by the international conventions and regulations in force or who, aged over eighteen, has not, after a period of three months or a longer period set by decree by the Conseil d’Etat has elapsed since entering France, has not been issued with a residence permit, pays a regularisation visa fee of 200 euros, of which 50 euros, non-refundable, is collected at the time of application for the permit.
This provision does not apply to refugees, stateless persons and beneficiaries of subsidiary protection and to foreign nationals mentioned in articles L. 423-22, L. 426-1, L. 426-2 and L. 426-3.
The visa mentioned in the first paragraph takes the place of the long-stay visa provided for in the last paragraph of article L. 312-2 if the conditions for applying for it are met.

Sans préjudice des dispositions de l’article L. 412-1, préalablement à la délivrance d’un premier titre de séjour, l’étranger qui est entré en France sans être muni des documents et visas exigés par les conventions internationales et les règlements en vigueur ou qui, âgé de plus de dix-huit ans, n’a pas, après l’expiration depuis son entrée en France d’un délai de trois mois ou d’un délai supérieur fixé par décret en Conseil d’Etat, été muni d’une carte de séjour, acquitte un droit de visa de régularisation d’un montant égal à 200 euros, dont 50 euros, non remboursables, sont perçus lors de la demande de titre.
Cette disposition n’est pas applicable aux réfugiés, apatrides et bénéficiaires de la protection subsidiaire et aux étrangers mentionnés aux articles L. 423-22, L. 426-1, L. 426-2 et L. 426-3.
Le visa mentionné au premier alinéa tient lieu du visa de long séjour prévu au dernier alinéa de l’article L. 312-2 si les conditions pour le demander sont réunies.
