Article L4383-5 of the French Public Health Code

The region is responsible for the operation and equipment of the schools and institutes mentioned in article L. 4383-3 when they are public. It may participate in the financing of the operation and equipment of these establishments when they are private.

The operating and equipment grant is paid annually to the organisations that run these schools and institutes; the expenditure and resources of these establishments are identified in a specific budget.

The staff of schools and institutes under the authority of a public health establishment are recruited, managed and paid by this establishment in accordance with the provisions of law no. 86-33 of 9th January 1986 on statutory provisions relating to the hospital civil service. Private schools and institutes recruit, manage and pay their own staff.

When the school or institute is part of a public establishment mentioned in Title I or Title IV of Book VII of the Education Code, the provisions of this article and the last paragraph of article L. 4383-2 of this Code are the subject of an agreement between the region and the public establishment, which replaces the authorisation and approval provided for in article L. 4383-3 of this Code.

Article L4383-5

La région a la charge du fonctionnement et de l’équipement des écoles et instituts mentionnés à l’article L. 4383-3 lorsqu’ils sont publics. Elle peut participer au financement du fonctionnement et de l’équipement de ces établissements lorsqu’ils sont privés.

La subvention de fonctionnement et d’équipement est versée annuellement aux organismes qui gèrent ces écoles et instituts ; les dépenses et les ressources de ces établissements sont identifiées dans un budget spécifique.

Les personnels des écoles et instituts relevant d’un établissement public de santé sont recrutés, gérés et rémunérés par cet établissement selon les dispositions de la loi n° 86-33 du 9 janvier 1986 portant dispositions statutaires relatives à la fonction publique hospitalière. Les écoles et instituts privés recrutent, gèrent et rémunèrent leurs personnels.

Lorsque l’école ou l’institut relève d’un établissement public mentionné au titre Ier ou au titre IV du livre VII du code de l’éducation, les dispositions du présent article et du dernier alinéa de l’article L. 4383-2 du présent code font l’objet d’une convention entre la région et l’établissement public, laquelle tient lieu de l’autorisation et de l’agrément prévus à l’article L. 4383-3 du présent code.
