When an insurance undertaking carries out operations falling within the scope of Article L. 441-1, it must keep subsidiary allocation accounts for each agreement.
The assets corresponding to these transactions are allocated to the settlement of benefits, whether or not they have been paid. To this end, they are subject to
a) A legal mortgage on the buildings, which takes effect on the date of registration;
b) a preferential right on movable property and a preferential right on immovable property which take precedence over the preferential rights provided for respectively in the first and second paragraphs of article L. 327-2.
