The deliberations of the Assembly of Corsica, the acts of the President of the Assembly of Corsica as well as the deliberations of the Executive Council, the decrees of the President of the Executive Council deliberated within the Executive Council and the acts of the President of the Executive Council are subject to legality control under the conditions set out in Chapter II of Title IV of Book I of this Part.
Notwithstanding 1° of article L. 4141-2, are not subject to the obligation to transmit to the State representative, as provided for in article L. 4141-1, deliberations taken by the Assembly of Corsica or, by delegation, decisions taken by the President of the Executive Council of Corsica, relating to road and parking fee tariffs, the classification, declassification, establishment of alignment and levelling plans, the opening, straightening and widening of roads located within the territory of the collectivity of Corsica.
Without prejudice to article L. 4141-2, the obligation to transmit to the State representative provided for in article L. 4141-1 the regulatory and individual decisions taken by the President of the Corsican Executive Council in the exercise of his police powers pursuant to Article L. 3221-4, excluding those relating to traffic and parking.
Where, pursuant to the provisions of article L. 4142-1, the State representative shall attach to an appeal against a decision taken pursuant to the provisions of II of Article L. 4422-16 with a request for suspension, this deliberation ceases to have effect until the administrative court has ruled on this request. If the administrative court has not given a ruling within two months of the matter being referred to it, the deliberation becomes enforceable again.
