Article L4424-15-1 of the French General Code of Local Authorities

The sustainable development plan may be made compatible pursuant to article L. 300-6-1 of the town planning code.

The provisions proposed to ensure the compatibility of the plan are subject to a joint examination by the State, the territorial collectivity of Corsica and the associated public bodies mentioned in article L. 4424-13.

The compatibility project is subject to a public enquiry carried out in accordance with Chapter III of Title II of Book I of the Environment Code.

At the end of the public enquiry, any changes to the compatibility of the plan to take account of the opinions attached to the file and the results of the enquiry are approved by the Assembly of Corsica.

If the decision to make the plan compatible, as provided for in the previous paragraph, has not been taken within two months of the Assembly of Corsica receiving the opinion of the investigating commissioner or the enquiry commission, the compatibility of the plan is approved by decree in the Conseil d’Etat.

Le plan d’aménagement et de développement durable peut être mis en compatibilité en application de l’article L. 300-6-1 du code de l’urbanisme.

Les dispositions proposées pour assurer la mise en compatibilité du plan font l’objet d’un examen conjoint de l’Etat, de la collectivité territoriale de Corse et des personnes publiques associées mentionnées à l’article L. 4424-13.

Le projet de mise en compatibilité est soumis à une enquête publique réalisée conformément au chapitre III du titre II du livre Ier du code de l’environnement.

A l’issue de l’enquête publique, la mise en compatibilité du plan éventuellement modifié pour tenir compte des avis qui ont été joints au dossier et du résultat de l’enquête est approuvée par l’Assemblée de Corse.

Si la décision de mise en compatibilité prévue à l’alinéa précédent n’est pas intervenue dans le délai de deux mois à compter de la réception par l’Assemblée de Corse de l’avis du commissaire enquêteur ou de la commission d’enquête, la mise en compatibilité est approuvée par décret en Conseil d’Etat.
