I A. – The designation of the tourist communes mentioned in articles L. 133-11 and L. 134-3 of the Tourism Code is granted, by decree of the President of the Executive Council of Corsica taken for a period of five years, at the request of the commune or the public establishment of inter-communal cooperation competent in tourism matters and after consultation of the sites council and the departmental commission competent in matters of the environment, health and technological risks.
I. – The classification of the resorts mentioned in articles L. 133-13 and L. 134-5 of the same code is pronounced by deliberation of the Assembly of Corsica at the request of the municipality or the public establishment of inter-communal cooperation competent in matters of tourism and after consultation of the departmental commission competent in matters of the environment, health and technological risks and the council of sites and after a public enquiry carried out in accordance with chapter III of title II of book I of the environment code. The classification is valid for a period of twelve years.
Tourist communes that have been upgraded to classified tourist resorts retain the “tourist commune” designation for the duration of their classification.
II. – By way of derogation from the second paragraph of article L. 121-1 du code du tourisme portant répartition des compétences dans le domaine du tourisme, l’Assemblée de Corse détermine les règles de procédure relatives à l’instruction des demandes d’agrément ou de classement des équipements et organismes suivants:
a) Hotels and tourist residences;
b) Developed campsites;
c) Holiday villages;
d) Furnished villas, flats and rooms, which are rented on a weekly basis;
e) (repealed);
f) (repealed)
g) Tourist offices within the meaning of Articles L. 133-1 to L. 133-10 and L. 134-5 of the Tourism Code.
The decision to classify or approve these facilities or bodies is taken by order of the President of the Corsican Executive Council.
