Article L4436-4 of the French General Code of Local Authorities

Any draft or proposed decision of the Regional Council or the General Council that has an impact on the environment, the quality of life or concerns the cultural activities of the Amerindian and Bushinenge populations may be submitted to the Advisory Council for its prior opinion.

The Council deliberates on the draft or proposed decision within one month of the matter being referred to it. If it has not given an opinion within this period, its opinion is deemed to have been given.

The matter is referred to it, depending on the case, by the President of the Regional Council, the President of the General Council or the representative of the State.

Tout projet ou proposition de délibération du conseil régional ou du conseil général emportant des conséquences sur l’environnement, le cadre de vie ou intéressant les activités culturelles des populations amérindiennes et bushinenge peut être soumis à l’avis préalable du conseil consultatif.

Le conseil délibère sur le projet ou la proposition dans le mois de sa saisine. S’il ne s’est pas prononcé dans ce délai, son avis est réputé avoir été donné.

Il est saisi, selon les cas, par le président du conseil régional, le président du conseil général ou le représentant de l’Etat.
