Article L450-3-2 of the French Commercial code

I. – Where the establishment of proof of the infringement or breach depends on it and cannot be established otherwise, the officials mentioned in Article L. 450-1 may postpone the time at which they decline their status until at the latest the notification to the inspected person of the finding of the infringement or breach.

II. – For the monitoring of the sale of goods and provision of services over the internet and for the monitoring of the agreements or concerted practices referred to in Article L. 420-2-1, the agents mentioned in I may use an assumed identity.

A decree in the Council of State shall specify the conditions under which they shall make their findings.

Article L450-3-2

I. – Lorsque l’établissement de la preuve de l’infraction ou du manquement en dépend et qu’elle ne peut être établie autrement, les agents mentionnés à l’article L. 450-1 peuvent différer le moment où ils déclinent leur qualité au plus tard jusqu’à la notification à la personne contrôlée de la constatation de l’infraction ou du manquement.

II. – Pour le contrôle de la vente de biens et de la fourniture de services sur internet et pour celui des accords ou pratiques concertées mentionnés à l’article L. 420-2-1, les agents mentionnés au I peuvent faire usage d’une identité d’emprunt.

Un décret en Conseil d’Etat précise les conditions dans lesquelles ils procèdent à leurs constatations.
