Article L450-5 of the French Commercial code

The General Rapporteur of the Autorité de la concurrence shall be informed before they are launched of any investigations that the Minister responsible for the economy wishes to be carried out into facts likely to fall within the scope of Articles L. 420-1 to L. 420-2-2 and L. 420-5 or be contrary to measures taken pursuant to Article L. 410-3 and may, within a period set by decree, take over their management.

The rapporteur general shall be informed without delay of the results of the investigations carried out by the Minister’s departments. He may, within a period set by decree, propose to the Authority that it take up the matter on its own initiative.

Le rapporteur général de l’Autorité de la concurrence est informé avant leur déclenchement des investigations que le ministre chargé de l’économie souhaite voir diligenter sur des faits susceptibles de relever des articles L. 420-1 à L. 420-2-2 et L. 420-5 ou d’être contraires aux mesures prises en application de l’article L. 410-3 et peut, dans un délai fixé par décret, en prendre la direction.

Le rapporteur général est informé sans délai du résultat des investigations menées par les services du ministre. Il peut, dans un délai fixé par décret, proposer à l’Autorité de se saisir d’office.
