Where the Autorité des marchés financiers is not the competent authority for monitoring compliance with the disclosure requirements laid down in Article L. 451-1-2 of this Code and Articles L. 233-7 to L. 233-9 of the Commercial Code, and where it establishes that the issuer or the person required to provide the information referred to in I of Article L. 233-7 of the Commercial Code has breached its disclosure requirements, it shall inform the supervisory authority of the State party to the European Economic Area that is competent for monitoring such disclosure requirements. 233-7 of the Commercial Code, it shall inform the supervisory authority of the State party to the European Economic Area competent to supervise these disclosure requirements.
If, despite the measures taken by the latter or because of their inadequacy, the issuer, the financial institutions responsible for the placement or the person required to provide the information referred to in I ofArticle L. 233-7 of the Commercial Code persist in breaching the legislative or regulatory provisions applicable to them, the AMF may, after informing the supervisory authority competent to monitor the disclosure requirements, take all necessary measures to protect investors.
The AMF shall inform the European Commission of such measures.
