Article L464-8-1 of the French Commercial code

Decisions taken by the General Rapporteur of the Competition Authority pursuant to Article L. 463-4 to refuse protection of business secrecy or to lift the protection granted may be the subject of an action for review or annulment before the First President of the Paris Court of Appeal or his delegate.

The order of the First President of the Paris Court of Appeal ruling on this appeal may be appealed to the Court of Cassation.

This appeal is heard and decided in chambers.

A decree of the Conseil d’Etat shall specify the terms and conditions of this appeal.

Les décisions prises par le rapporteur général de l’Autorité de la concurrence en application de l’article L. 463-4 de refuser la protection du secret des affaires ou de lever la protection accordée peuvent faire l’objet d’un recours en réformation ou en annulation devant le premier président de la cour d’appel de Paris ou son délégué.


L’ordonnance du premier président de la cour d’appel de Paris statuant sur ce recours est susceptible d’un pourvoi en cassation.


Ce recours et ce pourvoi sont instruits et jugés en chambre du conseil.


Un décret en Conseil d’Etat précise les modalités de ce recours et de ce pourvoi.
