Article L4732-1 of the French Labour Code

Independently of the implementation of the provisions of article L. 4721-5, the Labour Inspector shall refer the matter to the judicial judge ruling in summary proceedings in order to order any measures likely to put an end to the risk, such as the decommissioning, immobilisation or seizure of equipment, machines, devices, products or other items, when he notes a serious risk of harm to the physical integrity of a worker resulting from non-compliance with the following provisions of this part as well as the texts adopted for their application:

1° Titles I, III and IV and Chapter III of Title V of Book I ;

2° Title II of Book II ;

3° Book III ;

4° Livre IV ;

5° Title I, Chapters III and IV of Title III and Title IV of Book V.

The judge may also order the temporary closure of a workshop or worksite.

The judge may impose a penalty on the decision, which is paid to the Treasury.

Indépendamment de la mise en oeuvre des dispositions de l’article L. 4721-5, l’inspecteur du travail saisit le juge judiciaire statuant en référé pour voir ordonner toutes mesures propres à faire cesser le risque, telles que la mise hors service, l’immobilisation, la saisie des matériels, machines, dispositifs, produits ou autres, lorsqu’il constate un risque sérieux d’atteinte à l’intégrité physique d’un travailleur résultant de l’inobservation des dispositions suivantes de la présente partie ainsi que des textes pris pour leur application :

1° Titres Ier, III et IV et chapitre III du titre V du livre Ier ;

2° Titre II du livre II ;

3° Livre III ;

4° Livre IV ;

5° Titre Ier, chapitres III et IV du titre III et titre IV du livre V.

Le juge peut également ordonner la fermeture temporaire d’un atelier ou chantier.

Il peut assortir sa décision d’une astreinte qui est liquidée au profit du Trésor.
