Independently of the implementation of the provisions of article L. 4721-5, the Labour Inspector shall refer the matter to the judicial judge ruling in summary proceedings in order to order any measures likely to put an end to the risk, such as the decommissioning, immobilisation or seizure of equipment, machines, devices, products or other items, when he notes a serious risk of harm to the physical integrity of a worker resulting from non-compliance with the following provisions of this part as well as the texts adopted for their application:
1° Titles I, III and IV and Chapter III of Title V of Book I ;
2° Title II of Book II ;
3° Book III ;
4° Livre IV ;
5° Title I, Chapters III and IV of Title III and Title IV of Book V.
The judge may also order the temporary closure of a workshop or worksite.
The judge may impose a penalty on the decision, which is paid to the Treasury.
