Article L4741-9 of the French Labour Code

Any person other than those referred to in article L. 4741-1 who, through his or her own fault, fails to comply with the provisions of articles L. 4321-2, L. 4321-3, L. 4411-1, L. 4411-2, L. 4411-6, L. 4412-2, L. 4451-1 to L. 4451-4 and the decrees of the Conseil d’Etat implementing them is liable to a fine of 3,750 euros.

A repeat offence is punishable by one year’s imprisonment and a fine of €9,000.

The fine is applied as many times as there are employees of the company concerned by the offence(s) recorded in the report referred to in article L. 8113-7.

Article L4741-9

Est puni d’une amende de 3 750 euros, le fait pour toute personne autre que celles mentionnées à l’article L. 4741-1, de méconnaître par sa faute personnelle les dispositions des articles L. 4321-2, L. 4321-3, L. 4411-1, L. 4411-2, L. 4411-6, L. 4412-2, L. 4451-1 à L. 4451-4 et celles des décrets en Conseil d’Etat pris pour leur application.

La récidive est punie d’un emprisonnement d’un an et d’une amende de 9 000 euros.

L’amende est appliquée autant de fois qu’il y a de salariés de l’entreprise concernés par la ou les infractions relevées dans le procès-verbal mentionné à l’article L. 8113-7.
