Article L481-11 of the French Commercial code

The person mentioned in article L. 481-1 that has benefited from a total exemption from a financial penalty under a leniency procedure is only jointly and severally liable to compensate the damage suffered by victims other than its direct or indirect contractors if these victims have not been able to obtain full compensation for their damage from the other joint and several debtors after having first unsuccessfully sued them.

La personne mentionnée à l’article L. 481-1 ayant bénéficié d’une exonération totale de sanction pécuniaire en application d’une procédure de clémence n’est tenue solidairement de réparer le préjudice subi par les victimes autres que ses contractants directs ou indirects que si ces victimes n’ont pas pu obtenir la réparation intégrale de leur préjudice auprès des autres codébiteurs solidaires après les avoir préalablement et vainement poursuivis.
