I. – After the expiry of the time limits fixed:
1° For the presentation of a bill of exchange at sight or at a certain time of sight;
2° For the making of the protest in default of acceptance or in default of payment;
3° For presentation for payment in the case of a clause of return without charge,
the bearer forfeits his rights against the endorsers, against the drawer and against the other obligees, with the exception of the acceptor.
II. – However, forfeiture shall only occur in respect of the drawer if he proves that he has made provision on the due date. In this case, the bearer only retains an action against the person on whom the bill of exchange was drawn.
III. – If the bill of exchange is not presented for acceptance within the period stipulated by the drawer, the bearer forfeits his rights of recourse, both for failure to pay and for failure to accept, unless it follows from the terms of the stipulation that the drawer only intended to exonerate himself from the guarantee of acceptance.
IV. – If the stipulation of a time limit for presentation is contained in an endorsement, the endorser alone may rely on it.
