Article L5111-6 of the French General Code of Local Authorities

The creation of a syndicate of communes referred to in Article L. 5212-1 or a mixed syndicate referred to in l’article L. 5711-1 or to article L. 5721-1 may only be authorised by the State representative in the department if it is compatible with the departmental inter-municipal cooperation scheme mentioned in article L. 5210-1-1 or with the rationalisation guidelines referred to in III of the same Article L. 5210-1-1.

This Article does not apply to the creation of a syndicate of municipalities or a mixed syndicate with competence in the construction or operation of pre-elementary or elementary schools, in the provision of early childhood education or in social action.

Article L5111-6

La création d’un syndicat de communes visé à l’article L. 5212-1 ou d’un syndicat mixte visé à l’article L. 5711-1 ou à l’article L. 5721-1 ne peut être autorisée par le représentant de l’Etat dans le département que si elle est compatible avec le schéma départemental de coopération intercommunale mentionné à l’article L. 5210-1-1 ou avec les orientations en matière de rationalisation mentionnées au III du même article L. 5210-1-1.

Le présent article n’est pas applicable à la création d’un syndicat de communes ou d’un syndicat mixte compétent en matière de construction ou de fonctionnement d’école préélémentaire ou élémentaire, en matière d’accueil de la petite enfance ou en matière d’action sociale.
