Article L512-10 of the French Consumer Code

The authorised agents may collect, on the spot or when summoned, any information, justification or document necessary for the controls.

The authorised agents pursuant to article L. 511-3 may, on being summoned or on site, hear any person likely to provide information useful to their findings. They shall draw up a report, which must include the questions to be answered. The persons interviewed read the minutes themselves, may have their observations recorded and sign them. If they state that they are unable to read it, the official will read it to them before signing. If they refuse to sign the report, this is noted on the report.

In accordance with Article 28 of the Code of Criminal Procedure, Article 61-1 of the same code is applicable when a person in respect of whom there are reasonable grounds for suspecting that he has committed or attempted to commit an offence is heard.

Les agents habilités peuvent recueillir, sur place ou sur convocation, tout renseignement, toute justification ou tout document nécessaire aux contrôles.

Les agents habilités en application de l’article L. 511-3 peuvent procéder, sur convocation ou sur place, aux auditions de toute personne susceptible d’apporter des éléments utiles à leurs constatations. Ils en dressent procès-verbal, qui doit comporter les questions auxquelles il est répondu. Les personnes entendues procèdent elles-mêmes à sa lecture, peuvent y faire consigner leurs observations et y apposent leur signature. Si elles déclarent ne pas pouvoir lire, lecture leur en est faite par l’agent préalablement à la signature. En cas de refus de signer le procès-verbal, mention en est faite sur celui-ci.


Conformément à l’article 28 du code de procédure pénale, l’article 61-1 du même code est applicable lorsqu’il est procédé à l’audition d’une personne à l’égard de laquelle il existe des raisons plausibles de soupçonner qu’elle a commis ou tenté de commettre une infraction.
