Article L512-18 of the French Consumer Code

The provisions of Article 11 of the Code of Criminal Procedure or those relating to professional secrecy do not prevent the communication, to the competent authorities of the Member States of the European Union and to the European Commission, of information and documents held and collected by competition officers, Consumer Affairs and Fraud Control officials in the performance of their duties of investigating and establishing infringements and breaches of the provisions falling within the scope of Regulation (EU) 2017/2394 of the European Parliament and of the Council of 12 December 2017 on cooperation between national authorities responsible for the enforcement of consumer protection laws and repealing Regulation (EC) No 2006/2004.

This communication shall be made in accordance with the terms and conditions of this Regulation.

Les dispositions de l’article 11 du code de procédure pénale ou celles relatives au secret professionnel ne font pas obstacle à la communication, aux autorités compétentes des Etats membres de l’Union européenne et à la Commission européenne, d’informations et de documents détenus et recueillis par les agents de la concurrence, de la consommation et de la répression des fraudes dans l’exercice de leurs missions de recherche et de constatation des infractions et des manquements aux dispositions entrant dans le champ d’application du règlement (UE) 2017/2394 du Parlement européen et du Conseil du 12 décembre 2017 sur la coopération entre les autorités nationales chargées de veiller à l’application de la législation en matière de protection des consommateurs et abrogeant le règlement (CE) n° 2006/2004.


Cette communication s’effectue selon les conditions et modalités de ce règlement.
