The authorised agents and the officers and agents of the judicial police may spontaneously communicate to each other the information and documents held or collected in the performance of their respective missions, without the provisions of Article 11 of the Code of Criminal Procedure or those relating to professional secrecy being an obstacle to such communication.
These information and documents may be communicated, for the performance of their respective duties with regard to product conformity or safety:
1° To the Nuclear Safety Authority and the Institute for Radiological Protection and Nuclear Safety mentioned in article L. 592-38 of the Environment Code;
2° To agents reporting to the Minister for Sport mentioned in article L. 232-11 du code du sport ;
3° To the European Commission or to the authorities of the other Member States of the European Union competent to check the compliance of products with the general safety obligation or the requirements of the Union harmonisation legislation mentioned in Annex I of Regulation (EU) 2019/1020 of the European Parliament and of the Council of 20 June 2019 on market surveillance and product conformity, and amending Directive 2004/42/EC and Regulations (EC) No 765/2008 and (EU) No 305/2011 or the enforcement of food or feed law, in the exercise of their market surveillance tasks ;
4° To the Agence nationale chargée de la sécurité sanitaire de l’alimentation, de l’environnement et du travail mentioned in article L. 1313-1 of the Public Health Code so that it can carry out assessments and expert appraisals falling within its remit.
