Article L512-48 of the French Consumer Code

By way of derogation from Article 167 of the Code of Criminal Procedure, if the experts disagree, or if they agree to overturn the conclusions of the State laboratory’s report, the public prosecutor or the court, before ruling, shall give this laboratory knowledge of the expert’s report and set a time limit for it to submit any observations, except in cases where the director of the laboratory concerned has himself taken part in the expert’s report as an expert.

Par dérogation à l’article 167 du code de procédure pénale, si les experts sont en désaccord, ou s’ils sont d’accord pour infirmer les conclusions du rapport du laboratoire d’Etat, le procureur de la République ou la juridiction, avant de statuer, donne à ce laboratoire connaissance du rapport d’expertise et lui fixe un délai pour faire parvenir éventuellement ses observations, sauf dans le cas où le directeur du laboratoire intéressé a participé lui-même à l’expertise en qualité d’expert.
