Article L5123-6 of the French Labour Code

When compensation resulting from national or regional professional or interprofessional agreements is intended to enable certain employees to benefit from an early retirement benefit, it must, in order to give entitlement to the exemptions and deductions provided for in article L. 5422-10, be implemented in compliance with conditions determined by decree by the Conseil d’Etat, linked to the age and characteristics, in particular the effects of exposure to certain occupational risk factors, of the activity of the beneficiaries.

Lorsqu’une indemnisation résultant d’accords professionnels ou interprofessionnels, nationaux ou régionaux, vise à permettre à certains salariés de bénéficier d’un avantage de préretraite, elle doit, pour ouvrir droit au bénéfice des exonérations et déductions prévues à l’article L. 5422-10, être mise en oeuvre dans le respect de conditions déterminées par décret en Conseil d’Etat, liées à l’âge et aux caractéristiques, notamment les effets de l’exposition à certains facteurs de risques professionnels, de l’activité des bénéficiaires.
