Subject to the provisions of Article L. 5125-4, applications for authorisation to merge have priority over applications to transfer. Applications for transfer authorisations are given priority over applications for new pharmacies.
For the opening of a pharmacy in a new commune or in communes mentioned in article L. 5125-6-1, priority is given, in compliance with article L. 5125-3 and the first paragraph of this article, to applications submitted by pharmacies in neighbouring communes.
Priority is given to applications from pharmacists who have never held a dispensary licence or who have not held one for at least three years at the time the application is submitted.
When the application for authorisation is submitted by a company or by several pharmacists in joint ownership, the principle of priority only applies when all the pharmacists who are partners or joint owners practising in the pharmacy meet the conditions for priority.
Any application for which a complete file has been submitted has priority over subsequent competing applications, under the conditions laid down by the decree referred to in article L. 5125-32.
