The optimal supply of medicinal products with regard to needs, as provided for in Article L. 5125-3 , is satisfied if the following cumulative conditions are met:
1° Access to the new pharmacy is easy or facilitated by its visibility, pedestrian facilities, parking and, where applicable, public transport services;
2° The premises of the new pharmacy meet the accessibility requirements set out in articles L. 164-1 to L. 164-3 of the French Construction and Housing Code, as well as the minimum installation requirements laid down by decree. They enable the tasks set out in article L. 5125-1-1 A of this code to be carried out and they guarantee permanent public access in order to provide an on-call and emergency service;
3° The new pharmacy supplies the same resident population or a previously unserved resident population or a resident population whose demographic development is proven or foreseeable with regard to building permits issued for individual or collective housing.
