Article L5125-3-3 of the French Public Health Code

By way of derogation from the provisions of article L. 5125-3-2, the optimal nature of the response to the needs of the resident population is assessed solely with regard to the conditions set out in 1° and 2° of the same article in the following cases:

1° The transfer of a pharmacy within the same district, or within the same municipality when it is the only pharmacy present within this municipality;

2° The grouping of pharmacies in the same district within the same municipality.

Article L5125-3-3

Par dérogation aux dispositions de l’article L. 5125-3-2, le caractère optimal de la réponse aux besoins de la population résidente est apprécié au regard des seules conditions prévues aux 1° et 2° du même article dans les cas suivants :

1° Le transfert d’une officine au sein d’un même quartier, ou au sein d’une même commune lorsqu’elle est la seule officine présente au sein de cette commune ;

2° Le regroupement d’officines d’un même quartier au sein de ce dernier.
