Any intermediary referred to in Article L. 519-7 registered in France, acting under a mandate issued by a credit institution, a finance company or a customer under the conditions laid down by decree of the Conseil d’Etat, who intends to carry on business for the first time in one or more Member States of the European Union or in another State party to the Agreement on the European Economic Area, under the freedom to provide services or the freedom of establishment, shall inform the body that keeps the register referred to in I of Article L. 512-1 of the Insurance Code.
Within one month of receiving this notification, this body shall inform the competent authorities of the host Member States of the intermediary’s intention to operate in their territory and shall at the same time inform the intermediary concerned.
The body shall also inform the competent authorities of the host Member State(s) concerned of the credit institutions or finance companies with which the intermediary in banking and payment services is bound by a mandate defined in Article L. 519-2.
The banking and payment services intermediary may commence business one month after the date on which he receives the information, transmitted by the body mentioned in the first paragraph, of the notification provided for in the second paragraph.
